Mold in Rental Properties: What You Need to Know
Understanding Mold
Mold is a type of fungus that thrives in damp environments. It can grow on walls, ceilings, and other surfaces when moisture is present. Common causes include:
- Leaks in plumbing or roofing
- Poor ventilation
- High indoor humidity
Mold can cause property damage and may affect indoor air quality. Addressing moisture problems promptly is the best way to prevent mold growth.
City of Salisbury’s Role
The City of Salisbury does not enforce mold cleanup or remediation. However, our Code Enforcement team will:
- Investigate structural issues that cause moisture, such as leaks or water intrusion.
- Require property owners/landlords to repair leaks or structural defects that lead to dampness.
If mold is present due to tenant neglect (e.g., failure to clean or use ventilation fans after showers), the city does not intervene.
Maryland Law on Mold
Under Maryland law:
- Landlords must provide tenants with a mold information pamphlet at lease signing and upon request. This pamphlet may be the EPA’s “Brief Guide to Mold, Moisture and Your Home.”
- Landlords must perform a mold assessment within 15 days after receiving written notice of mold from a tenant or local agency.
- If mold is detected, landlords must remediate within 45 days (or within a reasonable time if not feasible), following industry best practices.
- Landlords must maintain proper ventilation, control humidity, and comply with housing codes.
Local governments are not required to conduct mold assessments or remediation unless they own or manage the property.
Tenant Responsibilities
Tenants play a key role in preventing mold:
- Use ventilation fans in bathrooms and kitchens.
- Clean surfaces regularly to prevent mold growth.
- Report leaks or water damage to your landlord immediately.
- Maintain reasonable indoor humidity levels.
What To Do If You See Mold
- Identify the source of moisture (leak, condensation, poor ventilation).
- Notify your landlord in writing as soon as possible.
- Follow cleaning guidelines for minor mold caused by everyday use.
