On June 24, 2019 the Salisbury City Council approved ordinance number 2546 requiring any person desiring to locate, operate, or construct a hotel within the corporate limits of the City of Salisbury to first obtain a license from the City of Salisbury Business Development Department at 115 S. Division Street. A hotel is defined as a building or groups of buildings under the same management in which there are sleeping accommodations and primarily used by transients for lodging with or without meals. The term hotel shall include a hotel, an inn, a club, a motel, a bed and breakfast, or any other structure meeting the definition of hotel.
Moving forward, you will no longer be required to obtain a license from Wicomico County or an inspection from the Wicomico County Fire Protection Division to locate, operate, or construct a hotel within the corporate limits of the City of Salisbury.
The licensing period for the City runs from January 1st to December 31st of the same year. Upon application for an annual license you must submit proof of a fire safety inspection and approval of the City of Salisbury Fire Marshal, have no open violations with the City of Salisbury Housing & Community Development Office, and must have not outstanding bills or taxes due to the City of Salisbury. We strongly encourage you to make an application for your hotel/bed & breakfast licensure several months in advance of January 1 in order to allow for processing time. The application fee for a hotel license is $50 and can be paid via card by calling 410-677-1916 or check to 115 S. Division St., Salisbury MD 21801.
*Note* Bed and breakfasts are not a permitted use in most residential districts in City limits. The only residentially-zoned district that they are permitted is in the Newtown Historic District.
