    An update on Lot 10 from Mayor Taylor

    To all,
    I am writing to formally comment on the hearing for a Temporary Restraining Order held last Friday concerning Lot 10.  As you may be aware, in August, the City filed for a Complaint for Declaratory Judgment, Temporary Restraining Order, Preliminary Injunction, Permanent Injunction, and Other Relief against Mentis Lot 10, LLC, the Developer of Lot 10, seeking to enjoin Mentis from terminating the City’s right to use Lot 10 for municipal parking until such a time as Mentis has the ability to commence construction for a mixed-use development on the property by having the appropriate permits in place.
    This action was taken for two primary reasons:
    1.      To address Mentis’s apparent breach of contracts related to the development (or lack of development) on the Lot 10.
    2.      To safeguard the public’s interest in holding Mentis to the terms of the contract of sale and parking agreement.
    Although the Court did not find the present circumstances caused immediate and irreparable harm to the City, an extremely high standard, the Court suggested the City’s petition could succeed on the merits. The case is now moving forward to hearings on the City’s requests for a preliminary and permanent injunction later this year. We remain absolutely confident that the City has strong legal grounds to ultimately prevail in this matter.
